General Nyamwasa has been accused of committing war crimes in Rwanda and the Democratic Republic of Congo while serving as a general in the Rwandan Patriotic Army, and is the subject of various extradition requests – including requests from France and Spain – in respect of these and other international crimes. He was granted refugee status by the South African authorities despite being ineligible in accordance with domestic and international refugee law.
CoRMSA, with the support of SALC challenged the granting of refugee status and the North Gauteng High Court ruled that General Kayumba Nyamwasa is entitled to refugee status in South Africa. CoRMSA and SALC are seeking leave to appeal this judgment.
